terms of service.

these terms govern your use of folk, operated by Nozomio, Inc. ("nozomio", "we", "us"). by creating an account or using the service, you agree to these terms. if you do not agree, do not use folk.

folk is a cloud-hosted ai agent that you interact with through messaging platforms (imessage, telegram, discord, and others as they become available). each user gets an isolated sandbox environment with its own compute, storage, and credentials.

folk can execute code, browse the web, connect to third-party services, schedule tasks, and maintain persistent memory on your behalf. you are responsible for the instructions you give folk and the actions it takes on your behalf.

you must provide a valid phone number or telegram account to create an account. you are responsible for maintaining the security of your account. one account per person, one sandbox per account.

you must be at least 13 years old to use folk. if you are under 18, you must have permission from a parent or guardian.

folk requires a paid subscription at $20/month. payments are processed by stripe. your subscription renews automatically each month until you cancel.

you can cancel anytime from your dashboard (settings → billing → manage on stripe). when you cancel, you retain access until the end of the current billing period. we do not offer refunds for partial months.

we may change pricing with 30 days notice. if you do not agree to the new price, you may cancel before it takes effect.

you agree not to use folk to:

• violate any law or regulation.
• harass, threaten, or harm others.
• send spam or unsolicited messages through folk's messaging capabilities.
• attempt to access other users' sandboxes, data, or accounts.
• reverse-engineer, attack, or probe the service infrastructure.
• use folk to generate content that violates the acceptable use policies of the underlying ai model providers.
• resell or redistribute folk access without our written permission.

we reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on severity.

you own all data you provide to folk, including conversations, files, api keys, and memory content. we do not claim any ownership or license over your content beyond what is necessary to operate the service.

we do not use your data to train ai models. see our privacy policy for full details on how we handle your data.

folk integrates with third-party services (google, stripe, telegram, etc.) on your behalf. when you connect a third-party service, you are also subject to that service's terms. we are not responsible for the availability, accuracy, or policies of third-party services.

if you provide your own api keys (bring your own credentials), you are responsible for complying with the terms of those providers.

we aim to keep folk available 24/7, but we do not guarantee uninterrupted service. we may perform maintenance, deploy updates, or experience outages. we will make reasonable efforts to notify you of planned downtime.

folk relies on third-party infrastructure (ai models, cloud providers, messaging platforms). disruptions to those services may affect folk's functionality.

folk is provided "as is" without warranties of any kind, express or implied. to the maximum extent permitted by law:

• we are not liable for any actions folk takes on your behalf, including unintended consequences of instructions you give it.
• we are not liable for indirect, incidental, special, or consequential damages.
• our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim.

you can delete your account at any time from settings → privacy → delete my account. this permanently destroys your sandbox, data, and subscription.

we may terminate your account for violation of these terms, with notice when practical. if we terminate your account without cause, we will refund any prepaid, unused subscription fees.

we may update these terms from time to time. material changes will be communicated via the app or email at least 14 days before they take effect. continued use after the effective date constitutes acceptance.

these terms are governed by the laws of the state of Delaware, United States, without regard to conflict of law provisions.
